Contracting Parties
This document representing the Terms and Conditions of Use is the Contract for the Provision of Hosting Services on Virtual Servers, hereinafter referred to as "TOS". This TOS is concluded between you (hereinafter referred to as "you", "your" or "beneficiary") as beneficiary and HSCREATIVE SRL (hereinafter referred to as "our", "our", "TENUE", "HSCREATIVE SRL" or "provider") as provider of hosting services on virtual servers.
Being the most recent version of the TOS.
The use of our services constitutes the subject of this contract (TOS). HSCREATIVE SRL., with registered office at Calea Circumvalatiunii no. 2-4, Timisoara, is registered with the Trade Register Office under number J35/4339/2023, with CUI 49095801, represented by Mr. Sebastian H.
This Contract has been concluded, the provisions and clauses of which, agreed upon by virtue of the right to freedom of contract, have been established by our mutual agreement and in compliance with the law.
This contact (TOS) serves as the legal basis for all services provided by TENUE. TENUE reserves the right to modify, change, remove or add terms and conditions of this TOS, including, but not limited to: terms, applicable fines/taxes, operating policies, use/behavior of customers in relation to the image, TENUE employees.
TENUE may benefit from this right without prior notice or notification.
Regardless of previous communications/notices, continued use of the services represents your agreement to these changes. Periodic verification of the changes and modifications made to this TOS, as well as the correctness of the data provided by you, are entirely the responsibility of the Beneficiary.
TENUE reserves the right to choose customers.
By completing the order form and checking the "yes" box, you agree to the terms and conditions of use:
1. Represents a guarantee that you are a natural person, that you are at least 14 years old. If you represent a legal entity, partnership or any other legal form of organization in accordance with trade standards, your registration. It is a guarantee.
2. You agree to provide correct, clear and real information in the order form, including any type of information necessary for payment conditions and you undertake to update this information correctly and permanently.
3. Represents and guarantees that you have the authority to use the services in accordance with these TOS. If you do not agree / do not express your agreement to the terms or any other changes,the only option is to notify the payment department of the desire to unilaterally terminate this TOS;
4. If it is proven that the customer account data is false, Tenue has the right to close the account permanently without notice. In this regard, Tenue has the right to request a copy of the client's identity document. In the event of failure to present this document, the account data is considered to be false, which leads to the suspension of the account and all related services.
Attention! Forgery in documents/statements is illegal and is punishable by law!
Art. 326: Improper declaration of the truth, made to a person from those provided for in art. 175 or to a unit in which this person carries out his activity in order to produce a legal consequence, for himself or for another, when, according to the law or the circumstances, the declaration made serves to produce that consequence, is punishable by imprisonment from 3 months to 2 years or a fine.
Art. 331 Identity fraud: Presenting oneself under a false identity or attributing such an identity to another person, through the fraudulent use of a document that serves for identification, legitimization or proof of civil status or such a falsified document, in order to induce or maintain in error a public official or institution, in order to produce a legal consequence, for oneself or for another, is punishable by imprisonment from 6 months to 3 years.
Subject of the contract
It is the provision by TENUE of the following services:
Hosting of the contracted website or websites.
Hosting of contracted games.
Online and/or telephone technical assistance in exceptional cases for the use of hosting services.
Registration of domain names in the .ro and international .com, .net, .org, .info, .biz, .eu, etc.
Licenses Services.
Website Creation.
Web administration and maintenance.
Reseller Services.
Rental of virtual servers.
Value of services and payment terms
TENUE will issue proforma invoices based on which you will have to pay the equivalent of the contracted Service.
You will choose the billing frequency, initially through the order form, and then through a request addressed to the Payments department in writing by sending a ticket from the customer area or through the contact section.
The payment made validly is not refundable, even if you prematurely cancel the services offered in the first 14 days of validity of the contract.
Payment is made in euros or in lei at the NBR exchange rate + 2% from the day the proforma invoice is issued.
In case of non-payment, TENUE has the right to interrupt the provision of the service without any prior notice.
Interruption of the service means the SUSPENSION or DELETION of the account from the TENUE servers.
The decision on the form of interruption of the service belongs exclusively to the provider. By not paying for the services provided, the beneficiary expressly waives other rights and legal protection.
Switching to a higher or lower subscription can be done at any time, according to the technical possibility of the provider at that time and according to the rules established by this TOS or publicly displayed in the Frequently Asked Questions section.
The activation time of the ordered services is approximately 3-4 days from the confirmation of payment.
TENUE may at any time change the tariffs for the hosting service, or the bases on which any fee is determined or to establish any new fee.
In case of renewal, the prices may be changed without any prior notice.
The contractual period begins from the date your service was activated, and remains valid for the period selected by you in the order form.
If you wish to cancel the Service provided by TENUE, you must notify TENUE (the payments department) about this in writing via ticket or contact.
Renunciation of contracted services
TENUE may cease providing the contracted service by the beneficiary, immediately, irrevocably and without prior notice, if:
You have not complied with, violated or improperly treated these regulations, including any other TENUE regulations or have not complied with applicable Romanian law.
You have provided false information upon registration.
You have not complied with the conditions regarding the accuracy, clarity and validity of the registration data.
You have not responded to communications sent to the email address declared upon registration.
You are engaged in illegal, fraudulent activities or any type of activities - the sale of products or services that fall within the scope of the law.
You, a representative/employee of yours, a partner (legal entity or natural person) or a representative/employee of a partner is involved in a personal name or as a legal representative in activities that would prejudice the rights or reputation of our site. You have not paid the value of the contracted service.
Any termination of the services provided by TENUE shall be effective immediately. TENUE may optionally notify the customer of the termination of the provision of services. In addition to the terms mentioned above, any party to this agreement may terminate the present TOS if:
Any party fails to comply with the terms and conditions of this regulation and fails to take all necessary steps to remedy the situation within 30 days of receiving notice from the other party, except in the case of non-compliance with the payment obligation, and failure to honor the obligation for 5 calendar days from the moment of notification received from us. The other party is declared bankrupt and judicial liquidation proceedings have been initiated if the procedure is not withdrawn within 60 days of its commencement.
In the event that a state authority brings solid arguments that incriminate this TOS and the service, causing prejudice to the legal order, TENUE may suspend the service without any other related obligations.
If TENUE suspends only part of your Service due to non-compliance with the TOS, this does not suspend your obligation to pay the fees in full.
If TENUE suspends the entire Service, you are obligated to pay the fees related to the use of the service until the date mentioned in the registration agreement, applicable fees also in the case of early suspension.
If TENUE suspends the entire service due to non-payment of hosting services, in order to reactivate the service, you are obligated to pay the invoice or, as the case may be, the outstanding invoices.
You expressly waive any other rights and legal protections and conditions that may conflict with the terms provided in the TOS.
Ownership of hosting account information
Access to the hosting account on TENUE servers is done through a username and password sent by TENUE when activating the hosting account.
You agree to keep this password confidential.
You are responsible for maintaining the security of your account and you are fully liable for all activities that occur in your account and any actions taken in connection with your domain name, including those taken by users of email addresses on your domain or the actions of partners (their legal representatives or employees) engaged in the creation/maintenance and/or promotion of your site.
You agree to notify TENUE of any unauthorized access or other security breaches.
TENUE assumes no responsibility for any loss or damage related to your ability to remedy it. You acknowledge and agree that in no way is TENUE liable, in any way, for the actions or omissions of you or of the users of the hosting account resources to whom you give access, not even for damages caused in any way by them due to some actions or omissions.
In the event that some amounts of money must be paid as compensation or fines and not only, you will be obliged to pay these amounts of money, and not TENUE.
You or the partners or representatives of the partners to whom you have allowed access to the hosting account may not use the TENUE network to try to avoid authentication or to deceive the security of any server, network or other account.
This includes, but is not limited to: accessing data that is not intended for the client, logging into a server or account for which the client does not have authorized access, cracking passwords, checking the security of other networks looking for weaknesses or violating other security policies of the organization.
You, your partners or representatives of partners to whom you have allowed access to the hosting account, do not have the right to attempt to prevent or stop the service of any user, server or network.
This includes, but is not limited to denial of service attacks, mail bombing or other deliberate attempts to block a server or network. HSCREATIVE SRL will cooperate with authorities investigating breaches of the security of other sites' systems or networks, including with authorities investigating criminal acts.
Users who violate the security of systems or networks may be held liable through civil or criminal proceedings.
Using the service
All services offered by TENUE may only be used for lawful purposes.
The transmission, storage or presentation of information, data or materials that violate Romanian and international laws is prohibited.
Among these we can list, but are not limited to: materials copied without the permission of the owners, materials that are threatening or obscene, materials protected by trade secrets or with another status.
The client agrees not to seek compensation and not to hold TENUE liable for any claim resulting from the use of the service that harms the client or a third party.
How do I buy products from the website www.tenue.one?
TENUE sells its products online through STRIPE's online payment services. In this way, we can provide our customers with a secure and efficient online ordering and payment service.
You can buy our products online by following 3 steps:
a. Select the product you want to purchase and click on the "Buy now!" link
b. Enter your personal data. This information is necessary for the correct and efficient processing of the order placed by you. The entry of personal data is done using a 128-bit SSL encrypted connection. Personal information is not transferred to other third parties, neither by TENUE nor by payment operators. Be sure to fill out the form correctly and indicate the persons to whom billing and delivery will be made. The e-mail address is of utmost importance because information related to the order and the ordered products will be transmitted via e-mail. An incorrect e-mail address slows down the entire product ordering process. Moreover, TENUE will not be able to contact you and inform you about the status of your order. If the delivery address is not the same as the billing address, indicate this by selecting the menu at the end of the form. Choose the desired payment method and confirm the data by choosing "Next step".
c. Enter your credit/debit card data: If you have chosen the "Credit/debit card" payment method, you will need to fill out a form with your card information. For payments with credit/debit cards issued under the Visa and MasterCard logos (Visa/Visa Electron and Mastercard/Maestro), the "3-D Secure" system developed by these organizations is used, which ensures the same level of security for online transactions as those made at an ATM or in the physical environment at the merchant. "3-D Secure" ensures first of all that no information related to your card is transferred or stored, at any time, on our servers, this data being directly entered into the Visa and MasterCard systems. In addition, "3-D Secure" is a system for authenticating the identity of cardholders in an electronic environment. The cardholder authentication process is based on the security code known only to the cardholder and is carried out only on Visa or MasterCard servers, as the case may be. The "3-D Secure" system allows online purchases with any card issued under the Visa or MasterCard license, including debit cards and the electronic Maestro and Visa Electron cards. Virtual cards issued by these organizations are also accepted.
If the card transaction was successful, the next screen thanks you for ordering on our website and provides you with the relevant information for the order. You will also receive this information by e-mail.
Security policy
How safe is it for me to pay online? The risks associated with an online payment are:
The personal data entered by you to complete the order may come into the possession of third parties and be misused.
TENUE guarantees the security of its information systems.
Your data in the case of payments by bank card, card number, expiration date, etc. may come into the possession of third parties and be misused.
In the case of the "3D Secure" system applied by Stripe for payments with Visa or MasterCard cards, no information related to your card is transferred or stored, at any time, on our servers or on the Stripe servers, this being directly entered into the Visa or MasterCard systems, as the case may be.
In addition, if your card was issued by a bank certified in the "3D Secure" system, the transaction authorization is made only after your authentication in this system by entering a secret code/password known only to you, similar to the PIN code for ATM transactions. Read "Verified by Visa" and "SecureCode" for full details about the "3D Secure" system.
Payment methods
You can choose from the following payment methods: credit/debit card. If you have selected credit/debit card as the payment method, you will need to fill out a form with your details.
If the card transaction was successful, the next screen will thank you for ordering on our website and provide you with the relevant information for your order.
You will also receive this information by e-mail.
We accept the following credit/debit cards: Visa, Visa Electron, Mastercard/Eurocard, Maestro, including Visa or MasterCard virtual cards.
Using a credit/debit card as the payment method, your order will be processed immediately. For orders for which you have selected the payment method by bank transfer, the order will be processed only after confirmation of the crediting of the transferred amount to your account, thus introducing a 2-4 day delay, depending on the case.
Refund policy
There are two refund options within the first 14 days of purchase.
a) Services offered by TENUE, through hosting services, or services to which a refund cannot be applied after purchase, the value will not be returned even within the first 14 days of purchase.
b) Services to which a refund is applied within the first 14 days, only the difference in the amount until the purchased service is exhausted will be returned, not the first maximum 14 days. For this you must send an email to contact@tenue.one explaining the situation and requesting a refund.
Note! In the case of web domains, the payment is not refundable!
Note:
Child pornography is prohibited on our servers.
This prohibition also applies to all sites that promote illegal activities or contain materials that may harm our servers or any other servers on the Internet. Links to such materials are also prohibited.
TENUE is the sole authority in charge of deciding what materials constitute a violation of this provision. The client must also note that the distribution and/or transmission of obscene, indecent or otherwise offensive messages or materials may be punishable by law. Some examples of materials or links that are not acceptable:
Pirated software.
Hacker programs or archives.
Warez sites.
Proxy, and proxy platforms.
Software for sending unwanted emails (SPAM).
Downloading mp3, movies for which you do not have the consent of the copyright owner.
At this time we do not allow:
Running IRC software like eggdrop or BitchX.
Individual Chat Rooms for each client.
Programs that run continuously in the background.
Additionally, you may not post, send, retransmit or store any material using your hosting account that TENUE believes:
Violates any local or foreign law or regulation.
Is threatening, obscene, indecent, defamatory or otherwise harassing to an individual, group or entity.
Violates any right of any person, including copyright, trade secret, invention or other intellectual property rights, as well as
installing or distributing "pirated" software on other products that are not properly licensed for use, these examples are not limited to and include links to such servers.
You agree NOT to:
Upload, post, transmit or otherwise make available (reference) content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, invasive of another's privacy, adult, racially, ethnically or otherwise objectionable.
Harm minors in any way.
Impersonate another person or entity, including a TENUE official, forum moderator, guide or host, or otherwise misrepresent your affiliation with a person or entity.
Forge headers or otherwise manipulate identifiers to disguise the origin of content transmitted through TENUE servers.
Upload, post or transmit content that you are not entitled to communicate under the law or contractual obligations (for example, inside information, proprietary rights, confidentiality learned and discussed as part of an employment contract or under a confidentiality agreement).
Upload, post or otherwise transmit content that infringes on the patents, trademarks, trade secrets, copyrights, rights of privacy or publicity, or other proprietary rights of any party.
Upload, post or transmit unsolicited commercial email, also known as "spam".
This includes unfair marketing, advertising or other "spam" related activities, such as:
Sending mass emails to recipients who did not request email or sending with a false reply address Promoting a site through inappropriate links, titles, descriptions, or Promoting the site by repeatedly posting identical text in public forums.
Upload, post or otherwise transmit materials that contain viruses or other code, files or programs designed to interrupt, destroy or limit the operation of any software or hardware component of TENUE's or any third party's servers.
Disrupt or disrupt the Service or the servers or networks connected to the Service, or violate any requirements, procedures, policies or regulations related to the Service.
Violate, whether intentionally or unintentionally, any applicable local, state, national or international law or ICANN policies.
Provide material support or resources (or conceal or disguise the nature, location, source or ownership of material support or resources) to any organization.
Stalk or otherwise harass anyone.
Interfere with or disrupt the service or servers or networks connected to the Service, or disobey any requirements, procedures, policies or regulations of networks connected to the TENUE network.
Collect, transmit or store personal or financial data about any individual or entity.
Promote or provide training information about illegal activities, promote physical violence and insults against an individual or group, or promote any act of cruelty to animals.
This includes, but is not limited to, providing instructions on how to make bombs, grenades, or other weapons, and creating "Crush" sites.
You agree not to involve TENUE in any claims or complaints arising from the Service that cause harm to you or any other party.
TENUE reserves the right to investigate you, your business and/or your personnel, your site, your server, and the materials contained on the site at any time.
These investigations will be conducted solely for the benefit of TENUE and not for the benefit of you or any third party.
If the investigation reveals any information, action or omission that in TENUE's opinion constitutes a violation of national or international laws or regulations or TENUE's policies, it may immediately terminate your services and notify you of this action by email to the address provided in the order form.
You agree to waive any right of action or any claim you may have against TENUE for such actions.
Support, warranties and web domains
Tenue reserves the right to establish limits or extend any support provided for the contracted service, and the hours at which it is available.
You agree to provide guarantees to TENUE and its partners that you will have no claims or demands, including attorneys' fees, demanded by a third party due to its appearance in the Content of your site, your use of the Service, your relationship with the Service, your violation of the TOS or the violation of any other rights of another party, including, but not limited to, your use of the content, registered trademarks, trade names, copyrighted or patented materials or other intellectual property rights.
TENUE reserves the right, at its own expense, to assume the defense and control of any warranty on your part, but doing so does not relieve you of your warranty obligation. You acknowledge that TENUE may establish general practices and limitations on the use of the Service.
TENUE reserves the right to modify or discontinue the Service (or any component thereof) temporarily or permanently with or without notice, at any time.
You agree that TENUE is not liable to you or any other party for any modifications, suspensions or interruptions of the Service.
Domains are registered for a minimum period of 1 year and are optionally renewed for their use.
The customer is the sole holder of the right to use.
The termination of the use of domains occurs when, after 3 successive notifications, the customer does not make a new annual payment.
The registration and use of premium domains is subject to special charging and usage conditions.
The use of our domain registration platform for multiple requests for the purpose of rapid registration of premium domains is subject to special pricing and usage conditions. The transfer of premium domains is also subject to special pricing conditions obtained through negotiation with tenue.one.
Our platform does not have the ability to determine the price of a domain if it is premium.
Thus, we can indicate the availability of the domain and allow the order to be placed at the standard price.
If the domain is declared by the issuing authority as premium, then we will immediately return the amount paid by the client and inform him/her about the status of the domain and the price requested by the issuing authority for its registration.
In the case of domains that do not have the .RO ending, their registration is carried out only after confirmation of payment according to the proforma invoice issued through the order form.
If between the date of placing the order and the date of payment confirmation, the domain name you wish to purchase is registered by a third party beneficiary, you are given the option of either having the lei equivalent of the proforma invoice returned to you, at the NBR exchange rate on the day the invoice was issued, or of registering another domain name with the same ending.
Disclaimer
You understand and agree that:
Use of the Service is at your own risk.
The Service is provided on an "as is" basis.
Tenue makes no representations or warranties of any kind, express or implied, including, but not limited to, the implied warranties of merchantability or fitness for a particular purpose. Any material downloaded or otherwise obtained through use of the Service is done at your own risk and discretion and that you are solely responsible for any damage to your computer or loss of data resulting from the downloading of any materials.
Security mechanisms incorporated into the software (system) have inherent/effective limitations, and it is your responsibility to determine your exact needs.
Tenue does not warrant in this Agreement or any other terms provided that:
The Service will meet your exact requirements .
The Service will operate uninterrupted, secure, and error-free.
The results obtained from using the Service will be error-free and reliable.
The quality of the products, services, information or other materials purchased or obtained by you through the service will meet your expectations.
Any software errors will be corrected.
No advice or information, whether oral or written, obtained through or from the service creates any other warranties not expressly stated in this agreement.
Tenue assumes no responsibility for failure to meet deadlines, for the deletion, failure to provide or erroneous storage of any form of communication or any personalized settings used by you.
Tenue will make reasonable efforts to maintain the service, however, hscreative srl is not responsible for damage, loss of data, customer details or seller details, income or other damages to business due to delays, mistransmission or failure to transmit information, due to restriction or interruption of access, bugs or other errors, unauthorized use due to sharing access to the service, or other interactions with the service.
You are responsible for maintaining and safely backing up your data and any information stored through the service.
Limitation of obligations
Trial Services
TENUE offers the possibility to order a free trial service once every three calendar months, per beneficiary.
This trial service is intended for testing functionalities and cannot be used abusively.
TENUE reserves the right to refuse or suspend trial services for users who try to take advantage of this offer through repeated and unauthorized orders.
Any attempt to create multiple accounts or to circumvent the aforementioned restrictions will lead to the suspension of access and restriction of the associated account.
You understand and agree that tenue, its associates or other partners, directors, shareholders or employees of tenue are not liable for any direct, indirect, special, exemplary damages, including, but not limited to, damages for loss of future profits, goodwill, use, data or other intangible assets (even if you have warned tenue of the possibility of such losses), resulting from:
The use or inability to use the service.
Errors, defects, omissions, delays in operations or transmissions or any other irregularity in the proper functioning of the service or software.
The cost of procuring goods or services to replace those purchased or obtained through messages or transactions made through the service.
Unauthorized access to or alteration of your transmissions and data.
The statements and conduct of another party to the service.
Any goods or services offered or sold through the service.
Any other situation relating to the service or software.
Applicable law and force majeure
The applicable law of the TOS and the relationship between you and TENUE shall be governed by the laws of the Romanian State.
Except for the obligation to make payments, neither party shall be liable for any failure or delay in its actions or inactions governed by these TOS if they are due to a cause beyond its control such as (but not limited to) acts of war, government acts, Internet outages (not resulting from TENUE's actions or inactions), natural phenomena, earthquakes, embargoes, sabotage, labor disputes.
Such causes of force majeure must be notified to the other party promptly.
The party experiencing force majeure must use commercially reasonable efforts to promptly correct any malfunction or delay.
If TENUE is unable to provide the Service for a period of 30 consecutive days due to a continuous force majeure event, you You may terminate the Service, but TENUE will have no obligation to do so.
The relationship between the parties
This Agreement shall not create any partnership, joint venture, employment, franchise or agency relationship between TENUE and you.
Neither TENUE nor you shall have the power to bind the other party or create obligations for the other party without the prior written consent of the other party, except as expressly set forth in this Agreement.
TENUE and you agree that, except as expressly set forth in this Agreement, there shall be no third party beneficiaries of this Agreement, such as, but not limited to, insurance companies for any party or your users.
TENUE and you agree that, except as expressly set forth in this Agreement, there shall be no third party beneficiaries of this Agreement, such as, but not limited to, insurance companies for any party or your users.
Final clauses
This TOU constitutes an agreement between TENUE and you and governs your use of the Services, constituting the service contract between you and TENUE.
You may also be subject to additional terms or conditions of use that apply when you use other TENUE services, content or third-party software.
If any provision of these TOU or other incorporated documents is found by a court of competent jurisdiction to be invalid, the parties agree that such court will attempt to give effect to the parties’ intentions as reflected in the provision, and the remaining provisions will remain in full force and effect.
You agree that regardless of any other law or statute, any claim or cause of action arising out of or relating to these Terms or your use of the Services or the TOU must be filed within one year after such claim arose or shall be forever barred.
The section headings in these Terms are for convenience only and have no legal or contractual effect.
TENUE reserves the right to modify these TOS at any time.
If we modify these TOS, we will notify you by email or by posting the modification on our website.
If you do not agree to these modifications, please notify us in writing within 30 days of notification.
If you do not notify us within 30 days, you will be deemed to have accepted the modification.

Prezentul document reprezentand Termenii si Conditiile de Utilizare, este Contractul de Furnizare Servicii de gazduire pe servere virtuale, denumit in continuare "TCU". Prezentul TCU este incheiat intre dumneavoastra (numit in continuare "dvs", "al dvs." sau "beneficiar") in calitate de beneficiar si HSCREATIVE SRL (numit in continuare "nostru", "al nostru", "TENUE", "HSCREATIVE SRL " sau "furnizor") in calitate de furnizor de servicii de gazduire pe servere virtuale.
Fiind cea mai recenta versiune a TCU.
Folosirea serviciilor noastre constituie subiectul prezentului contract (TCU). HSCREATIVE SRL., cu sediu social in Calea Circumvalatiunii nr 2-4, Timisoara, este inregistrata la Oficiul Registrului Comertului sub numarul J35/4339/2023, avand CUI 49095801, reprezentata de Dl. Sebastian H.
S-a incheiat prezentul Contract, ale carui prevederi si clauze, convenite in virtutea dreptului libertatii contractuale, au fost stabilite prin acordul nostru comun si cu respectarea legii.
Prezentul contact (TCU) serveste ca baza legala pentru toate serviciile furnizate de TENUE. TENUE isi rezerva dreptul de a modifica, schimba, inlatura sau adauga termeni si conditii prezentului TCU, incluzand, dar nelimitandu-se la acestea: termeni, amenzi/taxe aplicabile, politici de functionare, utilizare / comportament a clientilor in raport cu imaginea, angajatii TENUE.
TENUE poate beneficia de acest drept fara notificari sau instiintari prealabile.
Indiferent de comunicarile/instiintarile anterioare, utilizarea continua a serviciilor reprezinta acordul Dvs. asupra acestor modificari. Verificarea periodica a modificarilor si schimbarilor intervenite in prezentul TCU, precum si corectitudinea datelor furnizate de Dvs. sunt in intregime responsabiliatea Beneficiarului.
TENUE isi rezerva dreptul de a alege clientii.
Prin completarea formularului de comanda si bifarea casutei "da" sunt de acord cu termeni si conditiile de utilizare:
1. Reprezinta o garantie ca sunteti persoana fizica, ca aveti implinita varsta de 14 ani. In cazul in care reprezentati o persoana juridica, parteneriat sau orice alta forma juridica de organizare in conformitate cu standardele de comert inregistrarea dvs. Este o garantie.
2. Sunteti de acord sa furnizati in formularul de comanda informatii corecte, clare si reale, incluzand orice tip de informatie necesara pentru conditiile de plata si va angajati sa actualizati in mod corect si permanent prezentele informatii.
3. Reprezinta si garanteaza ca aveti autoritatea de a utiliza serviciile conform prezentului tcu. In cazul in care nu sunteti de acord / nu va manifestati acordul asupra termenilor sau oricaror altor modificari, singura optiune este aceea de a notifica departamentul plati asupra dorintei de a rezilia unilateral prezentul tcu.;
4. In cazul in care se dovedeste ca datele contului client sunt false, tenue are dreptul sa inchida contul permament fara preaviz. In acest sens tenue are dreptul sa solicite clientului o copie a actului de identitate. In cazul neprezentarii acestui act se considera ca datele contului sunt false, fapt care duce la suspendarea contului si a tuturor serviciilor aferente acestuia.
Atentie! Falsul in acte/declaratii este ilegal si se pedepseste conform legii!
Art. 326: Declararea necorespunzatoare a adevarului, facuta unei persoane dintre cele prevazute in art. 175 sau unei unitati in care aceasta isi desfasoara activitatea in vederea producerii unei consecinte juridice, pentru sine sau pentru altul, atunci cand, potrivit legii ori imprejurarilor, declaratia facuta serveste la producerea acelei consecinte, se pedepseste cu inchisoare de la 3 luni la 2 ani sau cu amenda.
Art. 331 Falsul privind identitatea: Prezentarea sub o identitate falsa ori atribuirea unei asemenea identitati altei persoane, prin folosirea frauduloasa a unui act ce serveste la identificare, legitimare ori la dovedirea starii civile sau a unui astfel de act falsificat, pentru a induce sau a mentine in eroare un functionar sau o institutie publica, in vederea producerii unei consecinte juridice, pentru sine ori pentru altul, se pedepseste cu inchisoare de la 6 luni la 3 ani.
Obiectul contractului
Il constituie furnizarea de catre TENUE a urmatoarelor servicii:
Gazduirea siteului sau a siteurilor web contractate.
Gazduirea jocurilor contractate.
Asistenta tehnica online si/sau telefonica in cazuri exceptionale pentru utilizarea serviciilor de gazduire.
Inregistrarea de nume de domenii din zona .ro si internationale .com, .net, .org, .info, .biz, .eu, etc.
Licente Servicii.
Realizare Site.
Administrare si mentenanta web.
Reseller Servicii.
Inchirierea de servere virtuale.
Valoarea serviciilor si termenii de plata
TENUE va emite facturi proforme pe baza carora va trebui sa achitati contravaloarea Serviciului contractat.
Frecventa de facturare o veti alege dumneavoastra, initial prin intermediul formularului de comanda, iar apoi printr-o solicitare adresata departamentului Plati in scris prin transmiterea unui tichet din aria de client sau prin sectiune contact.
Plata efectuata valabil nu are caracter returnabil, nici in cazul in care renuntati anticipat la serviciile oferite in primele 14 de zile de valabilitate a contractului.
Plata se face in euro sau in lei la cursul de schimb a BNR + 2% din ziua emiterii facturii proforme.
In caz de neplata TENUE are dreptul de a intrerupe furnizarea serviciului fara nici o notificare prealabila.
Prin intreruperea serviciului se intelege SUSPENDAREA sau STERGEREA definitiva a contului de pe serverele TENUE.
Decizia asupra formei de intrerupere a serviciului apartine in exclusivitate furnizorului.
Prin neplata serviciilor furnizate beneficiarul renunta in mod expres la alte drepturi si protectie legala.
Trecerea la un abonament superior sau inferior se poate face in orice moment, conform posibilitatii tehnice a furnizorului la acel moment si conform regulilor stabilite prin prezentul TCU sau afisate public in sectiunea Intrebari Frecvente.
Timpul de activare a serviciilor comandate este de aproximativ 3-4 zile de la confirmarea platii.
TENUE poate schimba oricand tarifele pentru serviciul de gazduire, sau bazele pe care se determina orice taxa sau sa instituie orice noua taxa.
In caz de reinoire preturile pot fi schimbate fara nici o notificare prealabila.
Perioada contractuala incepe din data in care serviciul dumneavoastra a fost activat, si ramane valabila pentru perioada selectata de dumneavoastra in formularul de comanda.
In cazul in care doriti sa renuntati la Serviciul furnizat de TENUE trebuie sa anuntati TENUE (departamentul plati) despre asta in scris prin tichet sau contact.
Renuntarea la serviciile contractate
TENUE poate inceta furnizarea serviciului contractat de catre beneficiar, imediat, irevocabil si fara notificare prealabila, daca:
Dvs. nu ati respectat, ati violat sau ati tratat necorespunzator prezentul regulament, incluzand orice alte regulamente TENUE sau nu ati respectat legea romana aplicabila.
Dvs. ati furnizat la inregistrare informatii false.
Dvs. nu ati respectat conditiile referitoare la acuratetea, claritatea si validitatea datelor de inregistrare.
Dvs. nu ati raspuns comunicarilor trimise pe adresa de email declarata la inregistrare.
Dvs. sunteti angajat in activitati ilegale, frauduloase sau orice tip de activitati - vanzarea de produse sau servicii care intra in incidenta legii.
Dvs., un reprezentant/angajat al dumneavoastra, un partener (persoana juridica sau persoana fizica) sau un reprezentant/angajat al unui partener este implicat in nume personal sau ca reprezentant legal in activitati care sa prejudicieze drepturile sau reputatia site-ului nostru.
Dvs. nu ati achitat valoarea serviciului contractat.
Orice incetare a serviciilor oferite de TENUE are efecte imediate.
TENUE poate optional sa notifice clientul asupra incetarii furnizarii serviciilor.
Aditional termenilor mentionati mai sus orice parte a acestei conventii poate denunta prezentatul TCU daca:
Orice parte nu respecta termenii si conditiile prezentului regulament si nu depune toate diligentele necesare pentru a remedia situatia aparuta in timp de 30 de zile de la primirea preavizului de la cealalta parte, exceptand cazul nerespectarii obligatiei de plata, si neonorarea obligatiei timp de 5 zile calendaristice din momentul instiintarii primite de la noi.
Cealalta parte este declarata in stare de faliment si s-a pornit actiunea de lichidare judiciara daca procedura nu e retrasa timp de 60 de zile de la incepere.
In cazul in care o autoritate statala aduce argumente solide care incrimineaza prezentul TCU si serviciul, aducand prejudicii ordinii de drept TENUE poate suspenda serviciul fara alte obligatii aferente.
In cazul in care TENUE suspenda doar o parte a Serviciului Dvs., ca urmare a nerespectarii TCU, aceasta nu suspenda obligatia Dvs. de a plati taxele in intregime.
In cazul in care TENUE suspenda intregul Serviciu sunteti obligat la plata taxelor aferente utilizarii serviciului pana la data mentionata in acordul de inregistrare, taxe aplicabile si in cazul suspendarii inainte de termen.
In cazul in care TENUE suspenda intregul serviciu pe motiv de neplata a serviciilor de gazduire, pentru reactivarea serviciul sunteti obligat, la plata facturii sau dupa caz a facturilor restante.
Renuntati in mod expres la alte drepturi si protectie legala si conditii care ar putea fi in conflict cu termenii prevazuti in TCU.
Proprietatea informatiilor din cont de gazduire
Accesul la contul de gazduire pe serverele TENUE se face prin intermediul unui nume de utilizator si o parola transmise de catre TENUE in momentul activarii contului de gazduire.
Sunteti de acord sa pastrati aceasta parola confidentiala.
Sunteti responsabil de mentinerea securitatii contului Dvs. si sunteti raspunzator pe deplin de toate activitatile ce se desfasoara in contul Dvs. si orice actiuni efectuate in legatura cu numele domeniului Dvs. inclusiv cu cele efectuate de userii adreselor de email de pe domeniul Dvs. sau de actiunile partenerilor (reprezentati legali sau angajatii acestora) angajati in realizarea/intretinerea si sau promovarea siteului Dvs.
Sunteti de acord sa anuntati TENUE de orice acces neautorizat sau alte brese de securitate.
TENUE nu isi asuma responsabilitatea pentru orice pierdere sau paguba care tine de posibilitatea Dvs. de a o remedia.
Luati cunostinta si sunteti de acord ca sub nici o forma TENUE nu este raspunzator, in nici un mod, pentru actiunile sau omisiunile dvs. sau ale utilizatorilor resurselor contului de gazduire, carora dvs. le dati acces, nici chiar in cazul pagubelor produse in orice fel de acestia datorita unor actiuni sau omisiuni.
In cazul in care vor trebui platite unele sume de bani cu titlu de despagubiri sau amenzi si nu numai, dvs. veti fi obligat sa platiti aceste sume de bani, ci nu TENUE.
Dvs. sau partenerii sau reprezentatii partenerilor carora le-ati permis accesul la contul de gazduire nu pot utiliza reteaua TENUE pentru a incerca sa evite autentificarea sau sa pacaleasca securitatea oricarui server, retea sau a altui cont.
Aceasta include, dar nu se limiteaza numai la: accesarea datelor care nu sunt destinate clientului, logarea la un server sau la un cont pentru care clientul nu are accesul autorizat, spargerea parolelor, verificarea securitatii altor retele cautand slabiciunile sau incalcarea altor politici de securitate ale organizatiei.
Dvs., partenerii sau reprezentatii partenerilor carora le-ati permis accesul la contul de gazduire, nu au dreptul de a incerca sa impiedice sau sa opreasca serviciul oricarui utilizator, server sau retea.
Aceasta include, dar nu se limiteaza la atacuri de tipul denial of service, mail bombing sau alte incercari deliberate de a bloca un server sau o retea. HSCREATIVE SRL va coopera cu autoritatile care investigheaza incalcarea securitatii sistemelor sau retelelor altor site-uri, inclusiv cu autoritatile care investigheaza fapte penale.
Utilizatorii care incalca securitatea sistemelor sau retelelor pot fi trasi la raspundere prin procese civile sau penale.
Utilizarea serviciului
Toate serviciile oferite de TENUE pot fi utilizate numai in scopuri legale.
Sunt interzise transmiterea, stocarea sau prezentarea de informatii, date sau materiale care incalca legile romanesti si internationale.
Printre acestea putem enumera, dar nu ne limitam numai la: materiale copiate fara permisiunea proprietarilor, materiale care profereaza amenintari sau cu caracter obscen, materiale protejate de secrete comerciale sau cu un alt statut.
Clientul este de acord sa nu ceara despagubiri si sa nu traga la raspundere TENUE pentru nici o pretentie rezultata din utilizarea serviciului care prejudiciaza clientul sau o terta parte.
Cum cumpar produse de pe site-ul www.tenue.one?
TENUE vinde on-line produsele sale prin intermediul serviciilor de plata on-line ale STRIPE.
In acest fel putem asigura clientilor nostri un serviciu sigur si eficient de comanda si plata on-line.
Puteti cumpara produsele noastre on-line urmand 3 pasi:
a. Selectati produsul pe care doriti sa-l achizitionati si apasati pe linkul "Cumpara acum!"
b. Introduceti datele dvs. personale. Aceste informatii sunt necesare pentru procesarea corecta si eficienta a comenzii plasate de catre dumneavoastra. Introducerea datelor personale se face utilizand o conexiune criptata SSL pe 128 biti. Informatiile personale nu sunt transferate catre alte terte parti, nici de catre TENUE, nici de catre operatorii de plati. Aveti grija sa completati formularul corect si sa indicati persoanele la care se va face facturarea si livrarea. Adresa de e-mail are importanta extrema deoarece informatiile legate de comanda si produsele comandate vor fi transmise via e-mail. O adresa de e-mail incorecta incetineste intregul proces de comanda a produsului. Mai mult de atat, TENUE nu va putea sa va contacteze si sa va informeze asupra starii comenzii dumneavoastra. Daca adresa de livrare nu este aceeasi ca adresa de facturare, indicati acest lucru prin selectarea meniului de la sfarsitul formularului. Alegeti metoda dorita de plata si confirmati datele alegand "Pasul urmator".
c. Introduceti datele despre credit/debit card: Daca ati ales metoda de plata "Card credit/debit" este necesar sa completati un formular cu informatiile despre cardul dumneavoastra. Pentru platile cu carduri de credit/debit emise sub sigla Visa si MasterCard (Visa/Visa Electron si Mastercard/Maestro) este folosit sistemul "3-D Secure" elaborat de aceste organizatii care asigura tranzactiilor on-line acelasi nivel de securitate ca cele realizate la bancomat sau in mediul fizic, la comerciant. "3-D Secure" asigura in primul rand ca nici o informatie legata de cardul dumneavoastra nu este transferata sau stocata, la nici un moment de timp, pe serverele noastre, aceste date fiind direct introduse in sistemele Visa si MasterCard. In plus, "3-D Secure" este un sistem de autentificare a identitatii posesorilor de carduri in mediu electronic. Procesul de autentificare a posesorului cardului se face pe baza codului de securitate cunoscut numai de posesor si se desfasoara numai pe serverele Visa sau MasterCard, dupa caz. Sistemul "3-D Secure" permite efectuarea de cumparaturi on-line cu orice card emis sub licenta Visa sau MasterCard, inclusiv cele de debit si cele electronice Maestro si Visa Electron. Sunt acceptate si cardurile virtuale emise de aceste organizatii.
Daca tranzactia prin card a fost reusita, urmatorul ecran va multumeste pentru comanda pe site-ul nostru si va ofera informatiile relevante pentru comanda. Aceste informatii le veti primi de asemenea prin e-mail.
Politica de securitate
Cat de sigur este pentru mine sa platesc on-line? Riscurile asociate unei plati on-line sunt:
Datele personale introduse de dumneavoastra pentru completarea comenzii sa intre in posesia unor terte parti si sa fie abuziv folosite.
TENUE garanteaza securitatea sistemelor sale informatice.
Datele dumneavoastra in cazul platilor prin card bancar, numar de card, data expirarii, etc. sa intre in posesia unor terte parti si sa fie abuziv folosite.
In cazul sistemului "3D Secure" aplicat de catre Stripe pentru plata cu carduri Visa sau MasterCard, nici o informatie legata de cardul dumneavoastra nu este transferata sau stocata, la nici un moment de timp, pe serverele noastre sau pe serverele Stripe, aceastea fiind direct introduce in sistemele Visa sau MasterCard, dupa caz.
In plus, in cazul in care cardul dumneavoastra a fost emis de catre o banca certificata in sistemul "3D Secure", autorizarea tranzactiei se face doar dupa autentificarea dumneavoastra in acest sistem introducerea unui cod/parola secreta stiuta numai de dumneavoastra , similar codului PIN la tranzactiile de la ATM.
Cititi "Verified by Visa" si "SecureCode" pentru detalii complete legate de sistemul "3D Secure".
Metode de plata
Puteti alege dintre urmatoarele metode de plata: card de credit/debit.
Daca ati selectat card de credit/debit ca metoda de plata, este necesar sa completati un formular cu datele despre acesta.
Daca tranzactia prin card a fost reusita, urmatorul ecran va multumeste pentru comanda pe site-ul nostru si va ofera informatiile relevante pentru comanda.
Aceste informatii le veti primi de asemenea prin e-mail.
Acceptam urmatoarele carti de credit/debit: Visa, Visa Electron, Mastercard/Eurocard, Maestro, inclusiv cardurile virtuale Visa sau MasterCard.
Folosind ca metoda de plata card-ul bancar de credit/debit comanda dumneavoastra va fi procesata imediat.
Pentru comenzi pentru care ati selectat metoda de plata prin transfer bancar, procesarea comenzii se va face doar dupa confirmarea creditarii contului cu suma transferata, introducandu-se astfel un decalaj de 2-4 zile, de la caz la caz.
Politica de returnare a banilor
Sunt doua variante de restituire in primele 14 zile de la achizitie.
a) Serviciile oferite de TENUE, prin servicii de hosting, sau servicile carora nu li se poate aplica restituirea sumei dupa achizitie nu se va returna valoarea nici macar in primele 14 zile de la achizitie.
b) Serviciile carora li se aplica returnarea sumei in primele 14 zile, se va returna doar diferenta de suma pana la epuizarea serviciului achizitionat, nu si primele maxim 14 zile. Pentru asta trebuie sa trimiteti un email la contact@tenue.one prin care sa explicate situatia si sa cereti returnarea banilor.
Nota! In cazul domeniilor web plata nu are caracter returnabil!
Nota:
Pornografia cu copii este interzisa pe serverele noastre.
Aceasta interdictie este valabila si pentru toate site-urile care promoveaza activitati ilegale sau contin materiale care pot aduce prejudicii serverelor noastre sau oricaror altor servere de pe Internet. Link-urile catre astfel de materiale sunt de asemenea interzise.
TENUE este singura autoritate in masura sa hotarasca ce materiale constituie o incalcare a acestei prevederi. Clientul trebuie de asemenea sa ia nota ca distribuirea si/sau transmiterea de mesaje sau materiale obscene, indecente sau care incalca legile bunei cuviinte si ale decentei pot fi pedepsite de legile in vigoare.
Cateva exemple de materiale sau link-uri care nu sunt acceptabile:
Software piratat.
Programe sau arhive pentru hackeri.
Site-uri de Warez.
Proxy, si platforme proxy.
Software pentru trimiterea de email-uri nedorite (SPAM).
Download mp3, filme pentru care Dvs. nu aveti acordul proprietarului drepturilor de autor.
In acest moment nu permitem:
Rularea de software pentru IRC gen eggdrop sau BitchX.
Chat Room-uri proprii fiecarui client.
Programe care ruleaza in continuu in background.
Aditional, nu aveti voie sa postati, trimiteti sau sa retransmiteti sau stocati materiale cu ajutorul contului de gazduire pe care TENUE considera ca:
Violeaza o lege sau regulament local sau strain.
Este amenintator, obscen, indecent, defaimator sau poate afecata un individ, grup sau entitate.
Violeaza dreptul oricarei persoane, inclusiv drepturile protejate de copyright, secretul comercial, inventii sau alte drepturi de proprietate intelectuala, precum si
instalarea sau distribuirea de software "pirat" la alte produse care nu au licenta potrivita pentru utilizare, aceste exemple nu sunt limitative si se refera inclusiv la linkuri catre asemenea servere.
Sunteti de acord sa NU:
Uploadati, postati, transmiteti sau sa faceti disponibil (referire) prin alt mod continut care este ilegal, daunator, amenintator, abuziv, hartuitor, defaimator, vulgar, obscen, calomnios, care incalca intimitatea altora, cu caracter pentru adulti, rasial, etnic sau in alt mod condamnabil.
Prejudiciati minorii in orice fel.
Sumati identitatea altei persoane fizice sau juridice, chiar si a unui oficial TENUE, conducator de forum, ghid sau gazda, sau sa declarati in alt mod legatura dvs. cu o persoana fizica sau juridica.
Falsificati headerele sau sa manipulati in alt mod elementele de identificare pentru mascarea originii continutului transmis prin intermediul serverelor TENUE.
Uploadati, publicati sau transmiteti continut pe care nu aveti dreptul sa il comunicati sub incidenta legii sau a unor obligatii contractuale (de exemplu, informatii interne, drept de proprietate, confidentialitate invatate si discutate ca parte a unui contract de munca sau sub angajament de confidentialitate).
Uploadati, postati sau transmiteti in alt mod continut care incalca patentele (brevetele), marcile inregistrate, secretele de marca, drepturile de autor, drepturile la intimitate sau publicitate, sau alte drepturi de proprietate ale oricarei parti.
Uploadati, postati sau transmiteti emailuri comerciale nesolicitate, denumite "spam".
Aceasta include marketingul neloial, publicitatea sau alte activitati legate de "spam", cum ar fi:
Trimiterea de email-uri in masa catre recipienti care nu au solicitat email sau sa trimiteti cu adresa de raspuns falsa Promovarea unui site prin linkuri, titluri, descrieri neadecvate, sau Promovarea site-ul prin postarea repetata de texte identice in forumurile publice.
Uploadati, postati sau transmiteti in alt mod materiale care contin virusi sau alte coduri, fisiere sau programe realizate pentru a intrerupe, distruge sau limita functionarea oricarei componente software sau hardware a serverelor TENUE sau ale unei terte parti.
Conturbati sau sa intrerupeti Serviciul sau serverele sau retelele legate de Serviciu, sau sa incalcati cerintele, procedurile, politicile sau regulamentele legate despre Serviciu.
Incalcati intentionat sau nu orice lege locala, statala, nationala, sau internationala in vigoare sau politicile ICANN.
Furnizati suport material sau resurse (sau sa ascundeti sau sa deghizati natura, locatia, sursa sau proprietatea suportului material sau a resurselor) oricarei organizatii.
Urmariti sau hartuiti in alt mod pe cineva.
Interveniti sau sa intrerupeti serviciul sau serverele sau retelele conectate la Serviciu, sau sa nu respectati orice cerinte, proceduri, politici sau regulamente a retelelor conectate la reteaua TENUE.
Colectati, transmiteti sau sa stocati date personale sau financiare despre orice individ sau entitate.
Promovati sau sa furnizati informatii de pregatire despre activitati ilegale, sa promovati violenta fizica si jignirile impotriva unui individ sau grup, sau sa promovati orice act de cruzime fata de animale.
Aceasta include dar nu numai, furnizarea de instructiuni privitoare la realizarea bombelor, grenadelor si altor arme, si crearea de site-uri "Crush".
Sunteti de acord sa nu implicati TENUE, in orice cereri sau plangeri rezultand din Serviciu care va cauzeaza pagube dumneavoastra sau altei parti.
TENUE isi rezerva dreptul sa va investigheze pe dvs., afacerea dvs. si/sau personalul dvs., site-ul dvs., serverul dvs. si materialele continute de site in orice moment.
Aceste investigatii vor fi facute doar in beneficiul TENUE si nu pentru beneficiul dvs. sau unei terte parti.
Daca investigatia releva orice informatie, actiune sau omisiune care in opinia TENUE constituie o violare a legilor sau a regulamentelor nationale sau internationale sau a politicilor TENUE, va putea inchide imediat serviciile dvs. si sa notifice aceasta actiune prin email la adresa furnizata in formularul de comanda.
Sunteti de acord sa renuntati la dreptul de actiune sau orice revendicare pe care le-ati putea avea impotriva TENUE pentru asemenea actiuni.
Suport, garantii si domenii web
Tenue isi rezerva dreptul sa stabileasca limite sau sa extinda orice fel de suport oferit pentru serviciul contractat, si orele la care este disponibil.
Sunteti de acord sa oferiti garantii pentru TENUE si partenerilor sai ca nu veti avea pretentii sau cereri, incluzand taxele mandatarilor cerute de a o treia parte datorate aparitiei acesteia in Continutul site-ului dvs., folosirii de catre dvs a Serviciului, relatiei dvs cu Serviciul, incalcarii TCU de catre dvs sau incalcarii oricaror altor drepturi ale altei parti, incluzand, dar nelimitandu-se la utilizarea de catre dvs. a continutului, marci inregistrate, nume comerciale, materiale cu drept de autor sau patentate sau alte drepturi de proprietate intelectuala.
TENUE isi rezerva dreptul ca pe cheltuiala sa, sa isi asume apararea si controlul a oricarei garantii din partea dvs., dar facand acest lucru nu va scuteste de obligatie de garantie din partea dvs.
Ati luati la cunostinta ca TENUE poate stabili practici si limitari generale ale folosirii Serviciului.
TENUE isi rezerva dreptul de a modifica sau intrerupe temporar sau permanent Serviciul (sau orice componenta a acestuia) cu sau fara preaviz, in orice moment.
Sunteti de acord ca TENUE nu este raspunzator dvs sau unei alte parti de orice modificari, suspendari sau intreruperi ale Serviciului.
Domeniile se inregistreaza pe o perioada minima de 1 an si se reinnoiesc optional pentru folosinta lor.
Clientul este unicul detinator al dreptului de folosinta.
Incetarea folosintei domeniilor se face in momentul in care, dupa 3 notificari successive, clientul nu efectueaza o noua plata anuala.
Inregistrarea si utilizarea domeniilor premium este supusa unor conditii speciale de taxare si utilizare.
Utilizarea platformei noastre de inregistrare domenii pentru request-uri multiple in scopul inregistrarii rapide a domeniilor premium este supusa unor conditii speciale de pret si utilizare.
Transferul domeniilor premium este, deasemenea, supus unor conditii speciale de pret obtinute prin negociere cu tenue.one.
Platforma noastra nu are capacitatea de a determina pretul unui domeniu daca acesta este premium.
Astfel, noi putem indica disponibilitatea domeniului si permitem plasarea comenzii cu pretul standard.
Daca domeniul este declarat de autoritatea emitenta ca fiind premium, atunci vom proceda imediat la returnarea sumei platite de client si la informarea acestuia cu privire la statutul domeniului si la pretul cerut de autoritatea emitenta pentru inregistrarea acestuia.
In cazul domeniilor care nu au terminatia .RO, inregistrarea acestora se realizeaza doar dupa confirmarea platii conform facturii proforme emise prin formularul de comanda.
Daca intre data depunerii comenzii si data confirmarii platii numele de domeniu care se doreste a fi achizitionat este inregistrat de catre un tert beneficiar, vi se acorda fie posibilitatea de a vi se returna contravaloarea in lei a facturii proforme, la cursul BNR din ziua emiterii facturii, fie de a inregistra un alt nume de domeniu cu aceeasi terminatie.
Declinarea responsabilitatii
Intelegeti si sunteti de acord cu faptul ca:
Utilizarea serviciului se face pe riscul dvs.
Serviciul este furnizat pe baza: "asa este".
Tenue nu isi asuma responsabilitatea si nu acorda garantii de nici un fel, nici in mod explicit nici implicit, inluzand, dar nelimitandu-se la garantiile de comercializare obisnuite, la potrivirea pentru un scop anume.
Orice material downloadat sau in alt mod obtinut prin folosirea serviciului se realizeaza la discretia si riscul dvs si ca sunteti singurul responsabil pt orice stricaciune a computerului dvs sau pierderea de date rezultata in urma dowloadarii unor materiale.
Mecanismele de securitate incorporate in software(sistem) cunosc limitari efective/inerente, dvs avand responsabilitatea de a identifica exact necesitatile dvs.
Tenue prin prezentul acord sau alti termeni furnizati nu garanteaza ca:
Serviciul se potriveste exact cerintelor dvs.
Serviciul va functiona neintrerupt, in siguranta si fara erori.
Rezultatele obtinute prin folosirea serviciului vor fi fara greseala si de incredere.
Calitatea produselor, serviciilor, infromatiilor sau altor materiale cumparate sau obtinute de dvs prin serviciu vor indeplini asteptarile dvs.
Orice eroare a software-ului va fi corectata.
Nici un sfat sau informatie, orala sau scrisa, obtinuta prin sau de la serviciu nu creeaza orice alte garantii neprecizate in actualul acord.
Tenue nu isi asuma responsabilitatea pentru nerespetarea termenelor limita, pentru stergerea, nefurnizarea sau stocarea eronata a oricarei forme de comunicare sau oricaror setari personalizate utilizate de dvs.
Tenue va face eforturi insemnate pentru a intretine serviciul, totusi, hscreative srl nu raspunde pt stricaciuni, pierderi de date, detalii de client sau detalii de vanzator, venit sau alte pagube produse afacerilor datorate intarzierilor, transmiterea gresita sau netransmiterea informatiilor, datorate restrictiei sau intreruperii accesului, bug-urilor sau altor erori, folosirii neautorizate datorate impartirii accesului la serviciu, sau altor interactiuni cu serviciul.
Sunteti responsabil de intretinerea si salvarea in siguranta (back-up) datelor dvs si de orice informatie stocata prin serviciu.
Limitarea obligatiilor
Servicii Trial
TENUE oferă posibilitatea de a comanda un serviciu de tip trial gratuit o dată la trei luni calendaristice, per beneficiar.
Acest serviciu trial este destinat testării funcționalităților și nu poate fi folosit în mod abuziv.
TENUE își rezervă dreptul de a refuza sau suspenda serviciile trial pentru utilizatorii care încearcă să profite de această ofertă prin comenzi repetate și neautorizate.
Orice tentativă de a crea conturi multiple sau de a eluda restricțiile menționate va duce la suspendarea accesului și restricționarea contului asociat.
Intelegeti si sunteti de acord cu faptul ca tenue, asociatii sai sau alti parteneri, directorii, actionarii sau angajatii tenue nu au obligatii pentru orice paguba directa, indirecta, speciala, exemplara, inclusiv, dar nelimitandu-se numai la pagube de pierdere de castiguri viitoare, bunacredinta, folosire, date sau alte bunuri intangibile (chiar daca ati avertizat tenue de posibilitatea unor asemenea pierderi), rezultand din:
Folosirea sau imposibilitatea folosirii serviciului.
Erori, defecte, omisiuni intarzieri in operatii sau transmisii sau orice alta neregula a bunului mers al servicului sau a software-ului.
Costul procurarii de bunuri sau servicii pentru inlocuirea celor cumparate sau obtinute prin mesaje sau tranzactiilor realizate prin serviciu.
Acces neautorizat sau alterarea transmisiilor dvs si datelor.
Declaratiilor si comportamentului unei alte parti fata de serviciu.
Orice bun sau serviciu oferit sau vandut prin intermediul serviciului.
Orice alta situatie referitoare la serviciu sau la software.
Legea aplicabila si forta majora
Legea aplicabila TCU si relatia dintre dvs si TENUE va fi sub incidenta legilor Statului Roman.
Cu exceptia obligatiei de a efectua plati, niciuna dintre parti nu va fi responsabila pentru orice esec sau intarziere in actiunile sau inactiunile sale reglementate de acesti TCU daca acestea se datoreaza unei cauze pe care nu o poate controla cum ar fi (dar nelimitandu-se la acestea) acte de razboi, acte guvernamentale, intreruperea Internetului (care sa nu rezulte din actiunile sau inactiunile lui TENUE), fenomene naturale, cutremure, embargouri, sabotaj, conflicte de munca.
Aceste cauze de forta majora trebuie notificate celelalte parti promt.
Partea aflata in caz de forta majora trebuie sa utilizeze eforturi comerciale rezonabile ca sa corecteze prompt orice disfunctionalitate sau intarziere.
Daca TENUE nu este in stare sa poata oferi Serviciul pentru o perioada de 30 de zile consecutive din cauza unui eveniment de forta majora continuu, dvs. veti putea rezilia Serviciul, dar TENUE nu va avea nici o obligatie in legatura cu asta.
Relatia dintre parti
Acest acord nu va stabili nici o relatie de parteneriat, asociatiune in participatiune, relatii de munca, franciza sau agentie intre TENUE si dvs.
Nici TENUE, nici dvs. nu veti avea puterea de a lega cealalta parte sau sa creeeze obligatii pentru cealalta parte fara a avea un consimtamant prealabil de la aceasta, in scris, cu exceptia celor precizate expres in acest acord.
TENUE si dvs. sunteti de acord ca, exceptand cele precizate expres in acest acord, nu vor exista terti beneficiari ai acestui acord, cum ar fi companiile de asigurari pentru orice parte sau utilizatorii dvs, fara ca acest exemplu sa fie limitativ.

Clauze finale
Acest TCU constituie un acord dintre TENUE si dvs. si va guverneaza utilizarea serviciilor, constituind contractul de prestari servicii incheiat intre dvs. si TENUE.
Puteti de asemenea sa va aflati sub autoritatea altor termeni aditionali sau conditii de utilizare ce se aplica in momentul in care utilizati alte servicii TENUE, continut sau software al unui tert.
Daca orice prevedere a acestor TCU sau altor documente incorporate este dovedita de o institutie competenta ca fiind invalida, partile sunt de acord ca aceasta institutie sa incerce sa ia in consideratie intentiile partilor asa cum sunt reflectate in prevedere, iar restul prevederilor ramanand in vigoare.
Sunteti de acord ca fara a tine seama de alta lege sau statut, orice revendicare sau pricina ce reiese din acesti termeni sau sunt legati de utilizarea serviciilor sau a TCU trebuie inaintata in decurs de un an dupa ce aceasta cerere a fost ridicata sau va fi pentru totdeauna clasata.
Titlurile sectiunilor in acesti termeni sunt numai pentru convenienta si nu au nici un efect legal sau contractual.
TENUE, isi rezerva dreptul de a modifica aceste TCU in orice moment.
Daca modificam aceste TCU, va vom notifica prin email sau prin publicarea modificarii pe site-ul nostru.
Daca nu sunteti de acord cu aceste modificari, va rugam sa ne notificati in scris in termen de 30 de zile de la notificare.
Daca nu ne notificati in termen de 30 de zile, veti fi considerat ca ati acceptat modificarea.
